The freedom to articulate and debate ideas; a fundamental safeguard against the tyranny of the majority and claims of infallibility. According to Mill, the suppression of freedom of expression rests on the assumption that some people are “infallible,” a premise that is contrary to the nature of knowledge. Even erroneous opinions provide a necessary environment for the testing and justification of truth. Therefore, it is argued that only certain forms of speech that cause concrete and unjust harm to others (for example, systematic hate speech) may properly fall within the domain of law, whereas all other expressions that are offensive but non-harmful should remain protected.
